While a contract does not have to be dated in order to be valid and enforceable, it is a good idea to do so. Dating a contract will help you to positively identify it later if you need to and will help you place it in its proper chronological context.
An effective date is the date on which legal rights or obligations become binding between two or more parties. Effective dates arise in a broad range of circumstances. For example, contracts often include language stating that the entire contract becomes operational on a specific date.
The date on which an agreement is intended to take effect can be different to the date on which it is signed. Unless otherwise provided, an agreement takes effect once signed by all parties.
Modern Practice. Under modern rules, few if any states limit how you write dates in legal documents other than requiring standard American usage: the month first, the day second and the year last. Some attorneys spell out the month and use numerals for the day and year, while others use all numeric numbers.
An effective date is a specific date when an agreement or transaction between one or more parties becomes legally binding and the terms outlined in the contract begin to apply.
The contract date is usually written onto the front cover and the first page of the contract (although there is no legal requirement to do so). Generally this is the date that the last party signed the contract.
In traditional American usage, dates are written in the monthdayyear order (e.g. January 23, 2023) with a comma before and after the year if it is not at the end of a sentence, and time in 12-hour notation (1:12 am).
The contract date is the date often written on the cover or last page of the contract. The signature date is, unsurprisingly, the date written next to or below the signature of each party, showing the date they signed the contract.
A contract does not need a date to be valid. Most times, it will simply begin on the day it is signed.
Normally a contract comes into existence when it is made when there has been acceptance of an offer, and consideration (payment) has passed from one party to the other. An obligation in a conditional contract will not become effective until some condition (a circumstance or action) has been met.
