Youre required to submit a properly completed Form W-8BEN to the party or company thats providing you with income if youre a Canadian contractor earning income from a U.S. source. The form includes a declaration that youll include this U.S. income on your Canadian tax return.
In general, if you receive a Form W-8 that you can reliably associate with the payment and are permitted to rely upon (generally under the standards for foreign status claims for chapter 3 purposes), you are exempt from reporting the payment on a Form 1099 and withholding under section 3406.
Forms W-8 are valid for the year in which they are signed and for the next three calendar years. For example, a Form W-8BEN signed on March 5, 2018, remains valid through December 31, 2021, and must be resubmitted to IBKR no later than January 30, 2022.
Give Form W-8 BEN to the withholding agent or payer if you are a foreign person and you are the beneficial owner of an amount subject to withholding. Submit Form W-8 BEN when requested by the withholding agent or payer whether or not you are claiming a reduced rate of, or exemption from, withholding.
However, the key difference between the two is that W-8BEN applies to income from individuals or single owner entities like independent contractors and sole proprietors and the W-8BEN-E is for income from entities. In other words, W-8BEN is only for individuals, while entities are required to fill out W-8BEN-E.
Generally, a U.S. Green Card holder cannot provide Form W-8BEN, and must provide Form W-9 instead. If you did formally renounce your US Green Card, please provide a copy of your Form I-407 (Record of Abandonment of Lawful Permanent Resident Status).
Do not send Form W-8BEN to the IRS, and do not file it with a tax return. Instead, you should submit the completed form to the party that requests it. Typically, this is the person or group from whom you received payment.
Provide Form W-8BEN to the withholding agent or payer before income is paid or credited to you. Failure to provide a Form W-8BEN when requested may lead to withholding at a 30% rate (foreign-person withholding) or the backup withholding rate.
How Do I Fill Out Form W-8BEN? Part I Identification of Beneficial Owner: Line 1: Enter your name as the beneficial owner. Line 2: Enter your country of citizenship. Line 3: Enter your permanent residence/mailing address. Line 4: Enter your mailing address, if different.
