This is the third video in a little series we are doing on funding your revocable living trust. If you have watched any of my videos or have visited with me, you know that over and over and over again, I state that all of your assets must be in the name of your trust so that your trust is properly funded and when the time comes, your family avoids probate. Motor vehicles, however, present an interesting dilemma, first, its relatively easy to transfer car titles in the state of Oklahoma, second, we live in a very litigious society. I always tell people that if you get into a car accident, and they see that your car is titled in the name of the trust, that might automatically prompt some people to file a lawsuit because

Some banks and financial institutions do not allow debit cards for trusts or estate accounts. You can review the trust documents or ask your attorney to do so in order to determine what the trust allows.
The name of the trustee of the trust will be on title of your trust assets. So, if you put a bank account into your trust, you would need to rename the bank account to be your name, as trustee, followed by the name of the trust.
A living trust can help you manage and pass on a variety of assets. However, there are a few asset types that generally shouldnt go in a living trust, including retirement accounts, health savings accounts, life insurance policies, UTMA or UGMA accounts and vehicles.
In the state of California, for instance, you may hold up to $166,250 in assets, property, or accounts outside of a Trust and still avoid Probate. But if you have over $166,250 in your account, you should consider transferring it to your Trust so that your Beneficiary can receive their inheritance outside of Probate.
The designation of a beneficiary on a bank account generally takes precedence over the instructions outlined in a Will or trust.
In such cases, the trustee could arrange a secured credit card for the beneficiary. This will allow the beneficiary to use a credit card to demonstrate their financial responsibility. The trust will have a downside limited to the amount of the secured line.
When at the bank to transfer assets, you should have a Certificate of Trust or a summary of the trust that proves you are the grantor. That summary should include the exact name of your trust, the names and addresses of the trustee and successor trustees, and the date that the trust was established.
