An employer may require an employee to provide a medical note from a health practitioner such as a doctor, nurse practitioner or psychologist when the employee is taking the leave because of personal illness, injury or medical emergency if it is reasonable in the circumstances.
The no medical note rule just applies to personal emergency leave. An employer can still request medical notes or certificates to support a request for other types of leave. For example, Family Caregiver, Family Medical or Critical Illness leave requests could result in a demand for a doctors note.
A doctors note will typically include the date of examination and any restrictions or accommodations necessary for the individuals recovery, including how long you need to be excused from work or school and a doctors name or doctors signature.
If the employee has taken 2 or more PEL days that year already, then employers may request a doctors note as a precondition to sick pay, but not to substantiate the absence. If the employee has taken 10 or more PEL days that year already, then employers may request a doctors note to substantiate the absence.
What could happen if I dont produce a fit note to my employer? If your employer is not satisfied that you are ill, and no evidence of sickness is provided (despite requesting the same), it can withhold your statutory or contractual sick pay.
It is usually shift workers or hourly workers that are forced to provide one when they are sick. And in many cases they are people at the lower end of the wage scale. They often lose hours and income, then have to pay a doctor to get a note to justify their absence.
Many doctors youd see in person charge for sick notes, with prices ranging from $10 to $30.
In Ontario, employers are entitled to request certain medical information from employees, but it must be relevant to the job and necessary for legitimate business reasons. This information typically includes details related to an employees ability to perform their job safely and effectively.
