Give it a title that can be found by people using a few keywords during a patent search. Write a broad statement that gives the technical field related to your invention. Provide background information that people will need to understand, search for, or examine your invention.
Amendments to Claims You can change the claims of a patent without filing a new application unless you are making a new claim. If you are making a new claim, you will need to file a new patent application. Federal regulations governing the USPTO provide specific rules for amending patent claims.
The five primary requirements for patentability are: (1) patentable subject matter, (2) utility, (3) novelty, (4) nonobviousness, and (5) enablement.
The specification includes a written description of the invention and of the manner and process of making and using the invention that concludes with the claims to the invention, which must begin on a new page.
Patent applications: the three criteria Novelty. This means that your invention must not have been made public not even by yourself before the date of the application. Inventive step. This means that your product or process must be an inventive solution. Industrial applicability.
a description and a claim or claims; drawings, when necessary; an oath or declaration; and prescribed filing, search, and examination fees. The title should be as specific as possible in describing the invention.
Citation-sequence and citation-name format Author(s), inventors; patent holder, assignee. Title of patent. Country issuing the patent country code patent number. Publication date.
Here, the patent document will contain a summary setting out the general area of the invention, allowing the patent Examiner and others to understand the technical area within which the application lies. The next section of most patent documents contains a description of the background to the invention.
