Hi Im Michelle! Welcome back to finely revealed. In this episode I want to talk about real estate again and in particular I want to talk about mechanics liens. Oftentimes you will have friends and family help you out in making modifications or repairs to your property. but there are certain situations where you need a contractor or a handyman or a subcontractor with you as a contractor. Somebody to help you build a fence. dig a pool, re-landscape the yard. paint the house. add new gutters, redo the roof, redo the driveway, redo the walk, remodel entire bathrooms, remodel the kitchen add a finished basement. All of those types of things you should have an agreement with the party whos doing the work with a start and end time, and a cost. You should also have written change orders if you have a written contract so that you can keep track and things dont get out of hand. The reason that Im telling you this is because if these people are not paid what they claim theyre owed

A car lien is a lenders claim for repayment that they register against a car or other type of motor vehicle. Lenders have the right to place a lien on your car. Other companies like garages also have that right. Its called a mechanics lien. Liens stay registered on your car until youve paid your debt in full.
The potential lien claimant must record the mechanics lien within 90 days of: Completion of work, When the owner began using the improvement, or When the owner accepted the improvement. If the potential lien claimant fails to record the mechanics lien within the appropriate time frame, the lien isnt valid.
How does a Mechanics Lien work? Provide a pre-lien notice. A pre-lien notice informs the hiring party (and any other relevant parties) of your involvement in a specific project. Provide notice of intent to lien. Create and file the lien. Notify and serve the property owner. Release the lien or seek legal action.
Each province has different rules about the time limit of a lien. In Alberta, for example, your lien is valid for 180 days from the date the lien was placed. In Ontario, liens are only valid for 90 days from the date of last on site working.
Property owners can eliminate a lien through a process called bonding off. This involves purchasing a California Mechanics Lien Release surety bond for 125% of the amount of the mechanics lien. The bond will substitute for the real property to guarantee repayment of the debt, and the lien will be released.
A lien can be placed on a premises once the work has been completed or the materials have been supplied. The lien remains on the premises until the debt is paid, until a court order is obtained to remove the lien, or the property is sold by court order.
In Ontario, there is the Construction Act. This allows anyone supplying service or materials to put a lien on the property. This applies to anyone who provides services for either the owner, a contractor or even a subcontractor. The only exception to this is if the owner is the federal or provincial crown.
Mechanics Liens are a risk management tool to leverage payment from an overdue customer. A Mechanics Lien in these provinces ensures you have a secured interest in a property you have worked on- or supplied materials to a job site. Generally, liens are a collection tool in the event of non-payment.
