Now please note, I am not a CPA nor am I a tax preparer, so this video does not substitute contacting a tax professional. Maximum 2-year contract period A fixed term contract cant be for a period of more than 2 years, including renewals and extensions. No more than 2 consecutive contracts An employee cant have more than 2 consecutive contracts for the same or similar work, except in certain circumstances.
1.1 Employment in terms of a fixed term contract (newly concluded or renewed) for longer than 3 months will be deemed to become permanent employment with some exceptions (see below). Note an employer cannot circumvent this provision by using successive fixed term contracts limited to 3 months each.
This is not to say that it is forbidden for an employer to ever roll over a fixed term contract. The employer can do this, say once or at the most twice. If the contract has to be rolled over more than that, then it is either plain bad management, or the position must be declared permanent.
If there is no justifiable reason for fixing the term, the employee will be deemed to be a permanent employee if the agreement endures (or is renewed) beyond a period of three months.
