In the United States, it's illegal for a photographer to use someone's likeness commercially without a photo release form. Likewise, it's illegal for a client to use images from a photographer without the same permission. There are two main types of photo release forms.
A photo release form — sometimes called a media release or consent form — is an agreement between a photographer and an individual (most often, the subject of the photo), which gives the photographer the right to commercialize the picture.
You should use a photo release consent form any time you plan on using an image for commercial purposes. In other words, if your picture is going to generate money — even indirectly for marketing or sales purposes — you need a release form.
A print release is basically a document that allows your client to make other prints, including on various material(s) of the images they have received from you, the photographer. However, one key thing to keep in mind is that a print release is specifically geared to personal usage.
There should be something offered in return—called a consideration, in legal terms—so that the photo release is a fair, two-way street. Similarly, if you're signing over your rights to your images in a media release form, there should be some form of compensation.
A release is permission given by the person/people visible in the photo or the owners of property, brand or artwork that has been photographed. You may need to have a photo release form signed to be able to sell a photo, depending on the type of license your photo gets sold with.
Information to include. While there's no exact template, include at least the following: Names of both parties and whether they're giving or receiving permission to use the photo. Brief description of the images, the photographer, and the date.
