Per 14 CFR 91.227 and 91.225, each person operating an aircraft equipped with ADS-B Out must operate this equipment in the transmit mode at all times, unless authorized by the FAA or directed by air traffic control (ATC).
Is ADS-B In required? ADS-B In is not mandated by the ADS-B Rule; only ADS-B Out is required in order to fly in the airspace mentioned in 14 CFR 91.225. At the present time, the FAA does not plan to mandate ADS-B In.
An ADS-B function failure indicates that position data is no longer being received and therefore ADS-B equipment cannot perform its function due to a failure to receive the position source data. It is important that the flight crew be able to differentiate between an ADS-B device failure and an ADS-B function failure.
ADAPT is a RAID-based data protection level that maximizes flexibility, provides built in spare capacity, and allows for very fast rebuilds, large storage pools, and simplified expansion.
Civilian aircraft can turn off their ADS-B Out only if specifically instructed to do so by ATC, or if they are the non-lead aircraft in a formation flight, Duke said. Regulations as operationally complex as the ADS-B rules can be rife with unintended consequences, Harrison added.
Pilots can submit an ATC authorization request via ADAPT for operations of an aircraft with an inoperative ADS-B system, per 14 CFR 91.225(g)(1), by selecting ADS-B equipment repair as the reason for the request.
You can determine if your ADS-B Out system is meeting rule performance requirements by requesting a free Public ADS-B Performance Report (PAPR). Requesting a PAPR is the best and easiest way to check that your equipment is meeting all the requirements of 91.227.
