If you agree to change the amount of support If you and the other parent agree that you want to change a child support order, you will have to apply to make the change in the same court that made the original order. This is called bringing a motion to change.
TO MODIFY A CHILD SUPPORT ORDER: Hire an attorney to file the motion. File a pro-se motion (file the papers without the help of an attorney). IF THE PARENT IS GETTING ENFORCEMENT SERVICES THROUGH THE STATE, he/she can ask the Judicial Branchs Support Enforcement Services to file the motion for them.
To stop child support payments, the payor must file a motion to change with the court or make a written agreement with the recipient. The court will review the motion and determine whether child support should be terminated or varied. Payors should continue to make payments until a court order or agreement is in place.
There are also procedural, uncomplicated or unopposed motions, called 14Bs, where you ask the court for an order on consent for different procedural orders. An example of a 14B might be that both parties agree to allow a party to file a document late.
If you are the paying parent and have a new family to support, you are still required by law to financially support your children from your first relationship. However, having a second family to support is an example of a situation that could cause undue hardship for you or for your children.
In Ontario, you can file for or change child or spousal support through the court, or by a written agreement. In addition, child support can also be filed for or changed online. The process of filing for, or changing support payments can be complex. To get help, call a lawyer now.
In Connecticut, like with most states, a non-custodial parents child support obligation is calculated as a percentage of their total income compared to the needs of the child. Generally, this is 23% of your net weekly income for 1 child, 32% of your pay for 2 children, and 39% of your pay for 3 children.
If you are negotiating with the other parent of your child, you can make an agreement about child support that differs from the normal table amount but if the agreement isnt fair and doesnt properly care for the child, a judge may change the agreement if he or she is ever asked to.
