The copyright law requires that for a work to be protected by copyright, it must be original and creative. This means that the work must have been developed independently by its author, and should have some creativity involved in the creation.
Legally only the copyright owner has the right to authorise adaptations and reproductions of their work - this includes the making of a derivative work. The copyright owner is generally the creator of the original work, or it may be someone the creator has given copyright to (i.e. next of kin).
Adapting copyrighted material requires permission from the owner of the original work. Reproduction or performance of an adaptation may require the permission of both the owner of the rights for the original work, and of the rights holder for the adapted work.
