An Affidavit of Support is legally enforceable. The sponsors financial responsibility usually lasts until the applicant either becomes a U.S. citizen, or can be credited with 40 qualifying quarters of work (usually 10 years) under the Social Security Act.
The person who signs the Affidavit of Support is also called the sponsor. The petitioner must complete Form I-864; however if the petitioners income is insufficient, a joint-sponsor may agree to also complete an I-864 on the applicants behalf. An Affidavit of Support is legally enforceable.
To start the declaration, the person should state their complete name and address, as well as their country of citizenship. At the bottom of the declaration, the person should write: I swear, under penalty of perjury, that the foregoing is true and correct to the best of my knowledge.
If the petitioner/sponsor does not make enough money to meet the requirements of the Affidavit of Support, then another person can also file an Affidavit of Support and become a joint sponsor. The general rule is that there can be only one joint sponsor.
There is no filing fee to file Form I-864 with USCIS.
