Commonly Asked Questions about Texas Real Estate Documents

Before TREC even considers a contract form for promulgation, the Broker-Lawyer Committee must identify a real estate transaction requiring a standardized contract. There are six main sales contracts that TREC promulgates.
What is the difference between a TREC-approved form and a TREC-promulgated form? Promulgated forms are created specifically by the Texas Legislature, while approved forms are created by the Commission. Approved forms must be used, while promulgated forms may be used.
While anyone may use forms promulgated by TREC, the 150-plus Texas REALTORS forms are for the exclusive use of the associations members.
As public records, contract forms adopted by the Texas Real Estate Commission are available to any person. Real estate license holders are required to use these forms.
TREC promulgates the following six contracts: Unimproved Property Contract; One-to-Four-Family Residential Contract (Resale); New Home Contract (Incomplete Construction); New Home Contract (Complete Construction); Farm Ranch Contract; and Residential Condominium Contract.

Brokers and Agents Must Use TREC Forms Unless one is a real estate license holder, there is no required form for a residential real estate contract in Texas.
Here are the requirements to become a sales agent: Must be at least 18 years old. Must complete 180 hours of real estate courseworkbroken down by six coursesthrough an approved provider or have a four-year degree in real estate.
