The party must bring a subpoena form (AO-88, AO-88A or AO-088B) and be prepared to provide the case name and case number. The clerk will issue a subpoena, signed but otherwise in blank, to the requesting party. The party must complete the subpoena before service.
The report shall be filed by the officer with the clerk of the court issuing the subpoena, and the witness shall attend that session of the court, and for failure or refusal to do so may be punished for contempt.
In California, subpoenas can be invalidated for reasons such as improper signatures, issuing the wrong type, incorrect service, insufficient notice, failure to pay witness fees, mishandling experts or government workers, and incorrect treatment of out-of-state witnesses.
Either party may apply for a subpoena up to 48 hours before the trial date by applying to the Clerk of the Court. Service of a Subpoena: You must arrange for service of the Subpoena and the payment of a $15.00 witness fee, and where appropriate, travel expenses for the person subpoenaed.
Witnesses can ask for $35 a day and $0.20 per mile each way. If they ask to be paid before the court date, you must pay them. Otherwise they dont have to come to court.
