The law limits the amount of security deposits. o Until July 1, 2024, the limit is two times the monthly rent (or, for furnished units, three times the rent). o After July 1, 2024, the limit is one months rent.
New York State law requires security deposits to be returned in full. As their purpose is only to cover any damages if they have occurred during the tenancy, security deposits should remain intact.
If you dispute the landlords security deposit deductions or the amount the landlord claims they owe you, you must notify the landlord in writing within 60 days. If you do not notify the landlord of your dispute within 60 days, you will have waived your rights to challenge the landlords decision.
