To begin the Los Angeles probate process, a petition needs to be filed in a California Superior Court in the county where the deceased was living prior to his or her death. Approximately 30 days after the filing, a hearing will be set by the court.
The procedure may be initiated in the Surrogates Court earlier but the issuance of short certificates will not occur until the 11th day. This 10-day period allows for the filing of a caveat by an heir at law or beneficiary in a prior last Will.
Each county has a Surrogates Court and the Surrogate is the Judge of that court. The Surrogate is elected for a term of 5 years, pursuant to the Constitution of New Jersey, by the people of the county in which he or she has jurisdiction.
Probate is done when someone dies with assets in their name alone. The individual named in the Will as the Executor/rix (hereinafter referred to as the personal representative) would come to the office of the Surrogate with the original Will and a certified copy of the death certificate.
