What Are Tenants Rights and Responsibilities in Iowa? An Iowa tenant has the legal right to request a habitable unit to live in, make a written notice for repairs, and have due process before an eviction. If the landlord fails to comply with these terms, the tenant can seek legal help.
Failure to return the security deposit as required by law may be considered a bad faith retention of the deposit and may subject you to statutory damages of up to twice the amount of the security deposit, in addition to actual damages. California Civil Code 1950.5(l).
Sections 92.101 through 92.110 of the Texas Property Code describe the legal protections tenants have when they pay a security deposit. Section 92.103 states: the landlord shall refund a security deposit to the tenant on or before the 30th day after the date the tenant surrenders the premises.
The maximum security deposit amount an Iowa landlord can collect must be equal to two months rent. Additionally, Iowa state law allows a landlord to ask for a separate pet deposit. Service animals used by people with disabilities are exempt from this.
If the landlord keeps the security deposit in bad faith, the tenant may be able to recover up to two months rent as punitive damages (which are damages meant to punish a defendant), in addition to actual damages.
Iowa law allows landlords to charge a security deposit up to two months rent, requires them to hold deposits in a federally insured institution, and mandates the return of the deposit within 30 days of the tenant vacating the property​​​​.
For tenants in units that are not rent stabilized or rent controlled, the landlord must return the security deposit within 14 days of the tenant moving out. If the landlord takes any money out of the security deposit for damages, they must provide an itemized receipt describing the damage and its cost.
After a lease ends, the landlord can deduct money from the security deposit only for the following reasons: unpaid rent and fees. cleaning and repairs to restore the rental unit to its move-in condition, but not for ordinary wear and tear.
