An affidavit of indigency is a request you can file with the court asking for a reduction or elimination of divorce filing fees.
How do I file an indigent in Texas? To waive your court fees, you can either fill out the Statement of Inability to Afford Payment of Court Costs or an Appeal Bond form or submit another sworn document that includes the same information. If you choose to submit a sworn document, it must be signed by a notary public.
If you are unable to pay court fees, you can file the Affidavit of Indigency Form to ask the court to waive those fees. The Affidavit of Indigency Guide and File program will help you fill out the form by asking you a series of questions in plain language.
If you cannot pay for court fees and costs, you may be able to have the state pay for them.
If you are financially unable to pay the fee go to Indigency (waiver of court fees) to see if you qualify to have your fees waived. If you qualify, you will need to file your Affidavit of Indigency with the forms required on the checklist.
