An easement can be created by an express grant, express reservation, implied grant or reservation, necessity, prescription, recorded covenant, dedication, condemnation, estoppel or court decision. The most common easements we deal with at Kendall Law are express, implied, necessity, prescription and court order.
Under Ohio law, the party seeking a prescriptive easement has the burden of proof and must establish in Court that they have been using a neighbors property in a manner that is (1) open; (2) notorious; (3) adverse to the neighbors property rights; (4) continuous; and (5) at least 21 years in duration.
Implied Easement Elements​ There must be a common ownership of a parcel and a transfer or conveyance of one parcel, or a portion of a parcel, to another. Prior to the division of title, there must have been an existing obvious, and apparently permanent, use of the quasi-easement by the common owner.
Include all relevant information Identify the existing property and the proposed easement. Specify what type of easement is being created (e.g. right of way, access, etc.) Include the legal description of the easement. Specify the duration of the easement (e.g. 20 years, in perpetuity, etc.)
