What type of notice is the landlord required to give to terminate the rental agreement? The landlord must give a 30-day written notice prior to the periodic rental due date if the tenant is a month-to-month tenant. The eviction process is legal in nature, and legal notice must be provided to the tenant in writing notifying them that the landlord wishes to evict them, and either giving the tenant a five or ten day advance notice depending on the reason for eviction.
To end a month-to-month tenancy in Arizona, the landlord must give the tenant at least 30 days written notice. The notice must inform the tenant that the tenancy will be ending in 30 days and the tenant must move out of the rental unit by then.
There is no law regulating what kind of advance notice, if any, is required to stay on or vacate when the lease ends. On occasion a lease will state that it automatically renews unless either party gives notice otherwise. More frequently, a 30-day or 60-day notice must be provided by one party to the other.
