As a condition of receiving an ERAP payment, a landlord must agree that these funds satisfy their tenants full rental obligation for the covered period. This agreement does not mean that a participating landlord can no longer evict a tenant for other reasons.
PROTECTIONS FOR TENANTS Once a landlord accepts an ERAP payment, the tenant cannot be evicted for not paying rent during the period covered or for an expired lease during the 12 months following this payment.
Eligible households may apply for ERAP up to two (2) times in a single twelve (12) month period from the date of the first application, during the public health emergency, and within 60 days of the end of a public health emergency, to access the rent assistance within the eligibility cap.
Up to 3 months of additional rental assistance if the household spends over 30 percent of their gross monthly income on rent. Up to 12 months of past due electric or gas utility arrears payments. ERAP relief is limited and will be denied to households that have already received 12 months of assistance.
You can stay in a New York City apartment for 90 days without paying rent before the landlord can initiate eviction proceedings against you. This does not mean that that the landlord will take no action prior to the 90-day mark; there are several steps leading up to the eviction notice.

Individuals will not be able to submit applications, or complete applications that have been started but not submitted, after 9:00pm on January 20, 2023.
