A trademark typically protects brand names and logos used on goods and services. A patent protects an invention. A copyright protects an original artistic or literary work. For example, if you invent a new kind of vacuum cleaner, you would apply for a patent to protect the invention itself.
Generic terms can never receive trademark protection. They are words or symbols that communicate what type of product or service is being offered. Email and modem are generic terms. Similarly, cereal is a grass, the edible part of which is used for a breakfast food.
Inventions and creative works of art cannot be trademarked; they are protected by patents and copyrights, respectively. Also, some brand elements cannot be trademarked because they do not identify the source of a product or service.
Subsequently, the distinction between the two is that a word mark can secure content just typographic treatment of an organization, while a trademark could ensure any signs, structures, or articulations the organization made to separate itself.
Selling: You can sell your trademark outright to another business or individual. This can be a lump sum payment or a percentage of future profits. Litigation: In some cases, you may be able to monetize your trademark by enforcing your rights through legal action against infringers.
Descriptiveness / lack of distinctiveness: Terms that literally describe items as they are (tomato, beer, copper or any other common word) cannot be trademarked as they must be reserved for general use. Similarly, marks that fail to indicate a particular commercial enterprise to consumers will not be registered.
In India, names and surnames cannot be used as trademarks unless they have a distinctive character. Furthermore, if those names were used dishonestly, they would not be granted trademark status.
You can not register marks that are inherently offensive or obscene. You can not register marks that are generic that simply name a type or class or product or service. For example, you cant trademark lamp for a company that makes lamps.
