Paid vacation time or sick time is not legally required in most areas of the United States, so even if you request time away, your employer usually does not have to give it to you. Your employer can generally deny your request for time off if you are using vacation time, paid time off (PTO), or sick time.
The leave request form helps employees to communicate their intentions to take time off work to their employer. This form allows your employees to request some time off from the employer in advance.
It is used to address attendance problems or misconduct involving leave abuse, and to give employees notice that they may be violating Civil Service Rules governing appropriate sick leave use. While on Sick Leave Restriction, employees may only use sick leave with medical certification from a health care provider.
Leave without pay (LWOP) is a temporary nonpay status and absence from duty that, in most cases, is granted at the employees request. In most instances, granting LWOP is a matter of supervisory discretion and may be limited by agency internal policy.
Although an employee may request annual leave for sick leave purposes, annual leave is subject to supervisory approval and may be denied.
In addition, a break in service occurs, effective the last day on pay status, whether or not a separation form is submitted, when an employee is off pay status for four (4) complete, consecutive calendar months without an approved leave without pay, furlough, or temporary layoff.
Why Do You Need It? If you are a government employee, you must request approval for time off, regardless of the reason that you need the time off from work. OPM 71 is the form that the U.S. Office of Personnel Management has designated as the approved document for this purpose.
Fact Sheet: Leave Without Pay The Family and Medical Leave Act of 1993 (FMLA) (Public Law 103-3, February 5, 1993), provides covered employees with an entitlement to a total of up to 12 weeks of unpaid leave (LWOP) during any 12-month period for certain family and medical needs.
