Ending the fixed-term tenancy early will break the agreement or break the lease. In this case, the tenant may owe the landlord money. For example, if a tenant has a one-year lease and moves out after two months, their landlord can apply for 10 months rent as compensation.
The Residential Tenancy Act requires a tenants one-month notice to be in writing, so avoid text and social media messaging. You must also consider the rules about service of documents when giving notice to end a month-to-month tenancy.
Typically, after one year, the tenancy continues on a month-to-month basis. However, its possible that the tenant must move out or sign a new tenancy agreement in order to stay. This is why reading the terms of your tenancy is important in understanding what happens when the fixed-term has ended.
A month-to-month tenancy, also called a periodic tenancy, does not have an end date. The tenancy renews each month unless the tenant or landlord ends it. Month-to-month tenancies allow tenants to stay in a rental unit for as long as they need as long as they pay rent and follow the tenancy rules.
Month-to-Month Tenancies For example, if you pay rent on the first day of the month and want to move out by May 31st, your notice must be received by your landlord no later than April 30th. Your notice must be in writing, so avoid email, text messaging, and social media.
Ending a fixed term A fixed term tenancy ends on the day specified in the rental agreement, unless both parties agree to an early termination. For example, if the fixed term is from January 1 to December 31, the tenancy automatically ends on December 31.

A landlord must follow four steps to enforce an eviction and remove an overholding tenant: Serve the tenant with a copy of the Order of Possession. Wait for the 2-day review period to expire. Take the Order of Possession to the BC Supreme Court and get a Writ of Possession.
