It is very common to take photos during surgery (assuming patient consent). These are generally for medical and educational purposes. Speak with your surgeon to discuss what you would like to have done regarding photo documentation. Every surgeon has their own preference.
The Designated Record Set defines all documents that together create a medical record. This must be clearly defined as it applies to your paper and electronic patient records. Therefore, for photographs to be properly controlled they must be identified as part of the designated record set.
The most important reason we take intra-oral photos is for you. Often you cant see what the conditions are in your mouth. By taking the intra-oral photos, we are able to show you what we see and let you know your best treatment options. Intra-oral photos are also helpful to our hygienists.
The only times taking a picture of a patient is a HIPAA violation is when a picture is taken by a member of a Covered Entitys workforce without the authorization of the patient and/or for a use or disclosure not permitted by the Privacy Rule.
Reduction in Medical Errors The picture is one more double check to make sure that the correct information goes into the correct chart. Please know this is a private chart and we cannot legally reveal your picture or anything else in your chart without your consent.
Can nurses take pictures with patients? Nurses can take pictures with patients if the pictures are going to be used for a purpose permitted by the Privacy Rule or if the nurses obtain a written authorization before taking the pictures.
Informed consent for the use of each image and each purpose must always be obtained from the patient or guardian. Specific and fully informed consent for photography should always be sought and granted before taking photographs.
