I want to share with you briefly about the biggest change in many many years to trademark application procedures the USPTO has enacted a new rule going into effect December 3rd 2022 that most office action responses will be due three months after the action is issued rather than six months which has been the time frame provided for more than 25 years my whole career in trademarks this is a huge change its very important to know about it and to be able to properly dock it and deal with the new time frame and extension is available for an additional three months but it comes with a filing fee if you want to hear more detail about the whole thing check out my latest video at ericpelton.tv

Co-branding is usually understood as the use of two or more trademarks on a single product, each mark belonging to a different owner and pointing to a different source. A common example of co-branding is a brand A car with brand B tires and a brand C sound system.
However, after your trademark is registered, you can request changes by filing a Section 7 Request for Amendment or Correction of Registration Certificate form.
However, if the two products are not related to one another and not likely to cause any confusion, then trademark law will not prevent the two companies from using the same name. Put differently, if the same name is registered in different trademark classes, this does not give rise to an infringement claim.
It should come as no surprise that one trademark application can cover only one mark. In other words, you may not register multiple trademarks in a single application.
Trademark Invalidation If the registration is less than five years old, the party challenging the trademark rights can rely on any ground that could have prevented registration initially. The likelihood of confusion and descriptiveness is the most common grounds asserted to invalidate trademark rights.
If a proposed trademark name is similar to an already registered one and could be confusing, the USPTO wont register it. To be that confusing, the trademark names must be identical and must belong in the same services or goods class.
If the variant of the trademark completely alters the distinctive character of the already registered trademark, a new registration must be filed for the variant that is being used, because otherwise it does not have registration protection, since it is already different from the one that is registered.
Your trademark isnt limited to one good or service. It can be used with many different goods or services, and include both goods and services.
If trademarks share a common word or term, the marks may be considered similar in appearance even if one of the marks adds other letters or another word to it, especially if the added material is descriptive or suggestive of the goods or services.
