Hi everybody my name is Leena Yousefi and Im the founder of YLaw group, a family law firm in beautiful British Columbia. In this episode I wanted to talk to you about how to prove a common law relationship. More and more nowadays couples decide not to get married and live together in a relationship such as common law but at the time of separation because you dont have a paper saying that you were married, disputes can arise with one person saying we were never common law, we were just dating and the other person saying of course we were common law we were like husband and wife. So in those situations the problem becomes were you common law or not? and to prove that you have to be aware of various factors that the courts will consider. You may be surprised to hear that you may not even need to live with somebody under the same roof to be considered common law. Items that can be used as proof of a common-law relationship include: shared ownership of residential property. joint leases or rental agreements. bills for shared utility accounts, such as: gas. electricity. important documents for both of you showing the same address, such as: drivers licenses. identification documents.
Share. A common-law relationship is when two people make a life together without being married. Quebec law officially calls these couples de facto couples or de facto union. To be considered a common-law couple in the eyes of the law, it is not always necessary to live together!
Common-law couples are officially known in Quebec law as de facto couples. These couples can create a written agreement called a contract to make clear the obligations of each person while they are in a relationship. The contract can also say what would happen if they separate.
Quebec is the only province with a civil code, which is based on the French Code Napolon (Napoleonic Code). The rest of Canada uses the common law. The Criminal Code is also considered a code, and it is used throughout Canada.
A cohabitation agreement spells out what will happen to the couples finances if they separate, especially if one spouse stays home to care for the children and is therefore financially dependent.
If you are not married or in a civil union, your de facto (common law) spouse will be recognized as your spouse if you have lived together for at least 3 years or if a child has been born or is to be born of your union or if you have adopted a child together.
While there is no consistent definition for common-law relationships, many governmental services, such as Revenu Qubec, state that a couple is considered common-law once theyve lived together for at least 12 months in a conjugal relationship or had a child together.
It should include information about: Property division. Spousal support. Inheritances, pensions, or other assets you wish to protect. All future properties, debts, including any jointly purchased assets.
