What does Strike out mean? The excision of written material from the record by the court, such that it may no longer be relied on. The courts power to strike out all or part of a statement of case is governed by CPR Rule 3.4. A strike out will usually will end the claim (or part thereof).
Motion to Strike This asks the court to take something out of the Complaint because it is not understandable, it is repetitive, it isnt legal, or it doesnt matter. This motion can help to limit what the case is about so you do not have to defend that part of the case.
Grounds for Strike outs There are several: no reasonable grounds to bring a claim: the case would not (if proved) make out any legally recognised cause of action. abuse of process: The process of the court has been used for a collateral purpose or ulterior motive of a litigant.
Striking Testimony: On some occasions, after a witness has testified, the judge will order certain evidence stricken from the record and will direct the jury to disregard it. When this is done, the jury will treat the evidence stricken as though it had never been given.
If you want to move to strike part of a witnesss testimony during the trial as irrelevant, inadmissible, or prejudicial, you must object immediately. Otherwise, you waive the objection if you delay and the witness answers the next question. If you wait too long, the court will overrule the motion to strike.

PRACTICE TIP: Courts consider striking a partys pleading as an extreme measure, and motions to strike are viewed with disfavor and infrequently granted. POL. Many courts consider filing this motion as a dilatory tactic. POL.
