A kick-out clause allows home sellers to continue showing and accepting offers even after accepting a contingent offer. A kick-out clause is a provision in a homes sales contract that allows sellers to accept a contingency while still showing their home in hopes of receiving a non-contingent offer.
In a nutshell, contingent with no kick-out means an offer has been accepted on the house and the seller cannot accept another buyers offer unless certain requirements are not satisfied.
What is a kick out clause and how does it work? A kick out clause is called that because it allows a seller to continue showing the house for sale and to kick out the buyer if the seller receives an offer from another buyer without a home sale contingency. Generally, this is how a kick out clause works.
Without the clause, the seller has no power and theres no way to get that buyer out. Typically, Pardees clauses give the first buyer 24, 48, or 72 hours to drop the contingency and proceed with the sale; if they cant perform within that time, the seller can kick them out of escrow.
A kick-out clause is a provision in a real estate contract that lets sellers accept a contingent offer while continuing to show the property and field offers. If they accept a second offer, the buyer can either remove their contingencies or get kicked out in favor of the new offer.
Heres an example: Lets say a buyer puts down an offer for $160,000 on a home and another buyer comes along a week later and offers $190,000 instead. If a 72-hour clause has been written into the contract, the original buyer now has 72 hours to make a better offer than $190,000.
A kick-out clause is an addendum to the purchase contract that can make it easier to sell your house fast. It enables the seller of a property to terminate the deal and sell it to another buyer in case the first buyer can no longer continue with the transaction for some reason.
