What If You Already Signed A Severance Agreement? If you are over the age of 40 and 7 days have not passed since you signed it, you can revoke it by giving notice to your employer in writing.
Offering the severance agreement to employees only over the age of 40 violates the ADEA. The law applies to employers with 20 or more employees. The Older Workers Benefit Protection Act (OWBPA) also protects employees over 40 from losing their benefits due to age. Each state has its own law as well.
If you fall into this category, you are protected by the Age Discrimination Employment Act (ADEA). If your severance package includes an ADEA waiver (and most of them do), you have 21 days to look over the general release and a seven-day period to revoke the release.
For example, a severance contract could include a severance pay term granting one weeks pay for each year of service to the employer. Although not required, some employers may also offer other severance benefits, such as job counseling or payment of COBRA expenses, as part of an overall severance package.
Employees age 40 or older must be given 21 days to consider the employers offer, unless it is part of a group termination. In a group termination, employees must be given 45 days. If the employee is younger than 40, there is no specified period of time which the employee must be given to sign the severance agreement.
Typical severance packages offer one to two weeks of paid salary per year worked. Continuation of insurance benefits, assistance finding another job, and other perks can be negotiated. You usually have 21 days to accept a severance agreement, and once its signedseven days to change your mind.
