Independent contracts must have work authorization to work in the U.S. It is a requirement under U.S. law, and the immigration system provides various options to work legally in the country. One of those options is the O-1 visa for independent contractors, however, it is not the only one.
People such as doctors, dentists, veterinarians, lawyers, accountants, contractors, subcontractors, public stenographers, or auctioneers who are in an independent trade, business, or profession in which they offer their services to the general public are generally independent contractors.
The tax-exempt organization will need the social security number or EIN of an independent contractor to complete Form 1099-MISC. If the independent contractor is a sole proprietor, the SSN is preferred.
In most cases, sole proprietors will just use their Social Security numbers. Again, an independent contractor can provide their Social Security numbers or federal employer ID numbers to clients.
Conversely, if the independent contractor is not a US person and did not perform any of their services within the US, you will not be required to issue Form 1099. Instead, the foreign contractor will have to complete and file Form W-8BEN.
If youre self-employed, you pay the combined employee and employer amount. This amount is a 12.4% Social Security tax on up to $160,200 of your net earnings and a 2.9% Medicare tax on your entire net earnings.
In the U.S., companies that engage with independent contractors require them to complete an IRS 1099 form to comply with American tax laws. U.S.-based companies paying international contractors should have contractors fill out an IRS Form W-8BEN, which certifies their foreign status in the eyes of the U.S. government.
All immigrants regardless of legal status are able to earn a living as independent contractors, or start a business using an ITIN or SSN. An independent contractor must pay self-employment tax and income tax. An independent contractor may use an ITIN to file and pay taxes instead of a SSN.
