In real estate wholesaling, an assignment fee is a financial obligation from one party (the assignor) who agrees to transfer their contractual obligations to another party (the assignee.) In laymans terms, the assignment fee is the fee paid by the end buyer to the real estate wholesaler.
This typically happens because once you close on your mortgage loan, your lender will quickly look to sell the mortgage note on to another entity. Doing so allows your mortgage provider to ensure future financial liquidity so that it can keep extending home loans to other borrowers.
However, the basic difference between participation and assignment is that the former involves the original lender continuing to manage the loan while the latter takes on the responsibility of doing so. As a rule, loan participation is a good option if the original lender does not want to keep the title of the loan.
Under an assignment of loan, a lender (the assignor) assigns its rights relating to a loan agreement to a new lender (the assignee). Only the assignors rights under the loan agreement are assigned. The assignor will still have to perform any obligations it has under the facility agreement.
The most common example of an Assignment of Mortgage is when a mortgage lender transfers/sells the mortgage to another lender. This can be done more than once until the balance is paid. The lender does not have to inform the borrower that the mortgage is being assigned to another party.
A loan modification is a restructuring of your current loan repayment period (term), interest rate, or other provision of your home loan. Occasionally, some of the principal balance of your existing loan may be forgiven and/or your loan term could be extended.
An addendum to a promissory note changes the terms of the original promissory note, which may include: Change in interest rate. Change in payment deadlines. Adding new clauses requiring collateral.
