Technically, unclaimed paychecks are subject to escheat laws as unclaimed property under the laws of the state where the employee last worked. This means that employers are required to follow their states laws for submitting unclaimed paychecks to the state. Not doing so can subject employers to fines and penalties.
Once Payroll receives the required completed documents, Payroll will process the request to reissue the paycheck. It may take up to 10 or more working days for the employee to receive the replacement paycheck. If the paycheck was damaged, a replacement may be issued sooner.
Documents can take days before theyre processed. Many companies manage expectations by advising that itll take around two weeks to receive a reissued paycheck.
Employees who still work for the employer are also entitled to their paycheck. If it is lost or destroyed, the employee should contact his companys accounting or payroll office to get a new check issued. The employer must verify that the check was never cashed, but once that is done, the employer must reissue a check.
In cases such as the paycheck not arriving due to the address being printed incorrectly or being sent to the wrong address because payroll didnt update the personnel records, the employer would take responsibility and reissue the check.
Generally, paychecks expire after six months. If an employee tries to cash an expired paycheck, their bank can choose whether to cash it or not. If a paycheck has been unclaimed for a long period of time, the payor must hand over the funds to the state in a process known as escheatment.
A replacement paycheck is issued in the event that a paper paycheck has been lost, destroyed, never received, or has become stale dated because it has not been cashed within 13 months of the issue date.
Federal Law The Fair Labor Standards Act (FLSA) does not prohibit employers from changing paydays. But the law states that wages must be paid when due, which generally means the next regularly scheduled payday. Beyond this provision, the FLSA does not place requirements on how frequently wages are paid.
