The words of the Pledge of Allegiance are familiar to almost every American. Yet few realize that its wording differs from its original version, penned in 1892. The main reason some people dont stand for or recite the pledge is typically that they believe that America does not provide liberty and justice for all, as it states. They refuse to say the pledge as a form of protest against whatever systemic injustice that they stand against.
Thats been true since 1943, when the Supreme Court ruled in the case of West Virginia State Board of Education v. Barnette that students couldnt be forced to salute the US flag or say the pledge because doing so would violate their First Amendment rights.
The Pledge of Allegiance has important significance. (A pledge is a kind of promise; it is a tradition in our country, and a way we honor the United States.) Reciting the Pledge of Allegiance shows respect for our country.
The 1943 U.S. Supreme Court ruling, West Virginia V. Barnette, determined that no school or government can compel someone to recite the Pledge of Allegiance or salute the flag. But states can still require it while offering exemptions.
You have a right to remain silently seated during the pledge. Note, however, that if you decline to say the pledge that you do not have the right to disrupt the proceedings. The ACLU has a long history of defending students right to decline to say the pledge.
The problem is, thats unconstitutional. The Supreme Court resolved this issue 80 years ago in West Virginia State Board of Education v. Barnette. The Court held that requiring public school students to pledge allegiance to the flag violates their First Amendment right against compelled speech.
