- Well hey there, this is Seth and in this video Im going to take you through the process of how to put together a warranty deed and a quick claim deed. If you know anything about deeds, those two types of deeds are actually very very different from each other but in terms of the actual information that has to go into the document, its fairly similar across both of them. Creating a deed is actually a fairly simple thing just in terms of what information you have to put in there and how to put it all together so if thats something youre trying to do, I just want to show you the basics of how that is done and Im gonna be showing you on a couple of blank templates that Ive used in the past and I will say that these deed templates Im going to be showing you do not work in all 50 states so dont just take these and start using them whenever you want to. You do not have to be an attorney to prepare a Florida quit claim deed. Absent attorney fees, your costs would only be the recording fees that the county comptroller charges and transfer fees if the property is mortgaged.
If you wish to remove someone from a deed, you will need their consent. This can be done by recording a new deed, which will require their signature. If the person in question is deceased, you will need their death certificate and a docHubd affidavit along with the new deed.
The legal term quitclaim can be used generally to mean abandoning any claim on a property, or more specifically for a type of legal document that does the same thing. A quitclaim allows a person to transfer property to another person with a simple deed.
Per state law, an Oklahoma quitclaim deed must be in writing, describe the property, and be signed by the grantor. The grantors signature must be acknowledged, and the deed must be recorded. When recording the deed, you will need to pay a recording fee and a documentary stamp tax, which is a transfer tax.
Quitclaim deeds lack certain protections and promises found in other types of deed to real property. Because of this, they should only be used under certain circumstances. These include transferring real estate between close family members, for instance, from a parent to a child.
A Quit Claim Deed is required to clearly identify the grantor and grantee, the address of the property being transferred, a legal description of the property, the manner in which the grantee is taking title, a docHubd signature of the grantor, and the name and address of the party that has prepared the deed.
In fact, taxes may be due on a quit claim deed even when the property is transferred between spouses. With such transfers, if the property is mortgaged, then tax is generally due on half of the outstanding balance.
