Im Keith Davidson at Albertson and Davidson today I want to talk to you about trustee removal and its important to understand how you have to go about trying to remove a trustee its no easy task but lets say youve come into my office and youve asked me how do I go about removing a trustee I have a trustee of my trust and for whatever whatever reason theyre not managing it properly so maybe theyre not investing right maybe theyre not making distributions to the beneficiaries when they should maybe theyre spending trust assets on themselves its any number of things and so the question is how do we go about removing the trustee and basically in order to remove a trustee in most instances youre going to have to go to court and seek the courts help now there are times when a trust document will give somebody the power to remove a trustee and thats important little footnote here so the first thing you want to do is look at your trust because if it gives the beneficiary or somebo

Trustees generally do not have the power to change the beneficiary of a trust. The right to add and remove beneficiaries is a power reserved for the grantor of the trust; when the grantor dies, their trust will usually become irrevocable. In other words, their trust will not be able to be modified in any way.
With an irrevocable trust, the transfer of assets is permanent. So once the trust is created and assets are transferred, they generally cant be taken out again. You can still act as the trustee but youd be limited to withdrawing money only on an as-needed basis to cover necessary expenses.
The only way to amend an irrevocable living trust is to have the consent of each and every beneficiary to the trust. Once they all agree upon the amendment(s) to the trust, they can compel modification of the trust with a petition to the court.
The grantor can opt to have the beneficiaries receive trust property directly without any restrictions. The trustee can write the beneficiary a check, give them cash, and transfer real estate by drawing up a new deed or selling the house and giving them the proceeds.
For example, if you transferred real estate into your trust, you would have done so by deed, granting it from your name personally into the name of your trust. If you want to take the property back, its simply a matter of drafting a new deed that grants title from your trusts name back to your name.
Can Beneficiaries Waive Their Inheritance? While a trustee cannot usually remove a beneficiary, a beneficiary who does not wish to get an inheritance can remove themselves from the trust distribution.
As the Trustor of a trust, once your trust has become irrevocable, you cannot transfer assets into and out of your trust as you wish. Instead, you will need the permission of each of the beneficiaries in the trust to transfer an asset out of the trust.
In the trust deed where there is no mention about amendment, the amendment has to be done with the permission of a civil court. Even the Civil Courts do not have unlimited powers of amendment. The Civil Courts permit amendment under the doctrine of Cy pres, which means the original intent of the settlor should prevail.
