Bereavement Leave California 2022: AB-2999 During COVID-19, AB-2999 was introduced to make job-protected bereavement leave mandatory in CA. The bill required employers to provide up to 10 days of unpaid bereavement leave. The leave must be completed within three months of the death.
AB 1949 takes effect on January 1, 2023. AB 1949 applies to employers with five or more employees. Employees are eligible for bereavement leave if they have been employed for at least 30 days before the leave commences.
Walmart allows employees to take 3 days of paid bereavement leave in the event of the death of an immediate family member.

AB 1949 amends the California Fair Employment and Housing Act (FEHA) to create a statutory right for eligible employees to take up to five days of bereavement leave upon the death of a covered family member. AB 1949 applies to all public agencies and all other employers with five or more employees.
Bereavement leave with pay will be granted for an employees absence from duty in the event of a death in the immediate family. An employee may utilize such leave to make funeral arrangements, settle family affairs, attend the funeral or memorial services, and for bereavement.
