I hereby amend my will as follows: It sets out the change(s) that the testator is making to their will using the Codicil. For example, it could set out the testators wish to appoint a certain person as a new executor, to remove somebody as a guardian, or to increase the amount of money left to somebody.
In short, no a Codicil to a Will does not have to be docHubd. However, laws and requirements vary from Province to Province. A Codicil does have to be signed in front of at least two witnesses who are not listed as beneficiaries, guardians, or executors in your Will.
As with a will, you cannot contest a codicil just because you dont agree with the terms or think they are unfair. Rather, you must have specific grounds to challenge the codicils legal validity.
Sign and date the codicil or new will in the presence of at least two adult witnesses who are not beneficiaries of the will. Witnesses must also sign and date the document to confirm its authenticity. Once you complete this step, your codicil or new will is legally binding.
Handwritten codicils to wills are accepted and considered legal in Alberta if properly executed. The same as another codicils, handwritten codicils must be formally and clearly dated and signed to be legally binding.
Right to Contest: Beneficiaries, those who benefit from a will, are entitled to contest a will if they believe it is invalid. Grounds for contesting may include lack of testamentary capacity, undue influence, fraud, or improper execution of the will.
As with many things in law, there is a limitation period for individuals to contest the validity of wills. In Ontario, that limitation period is two years from the date the potential challenger discovered their case. Note that this is not two years after the death of the testator.
