Hello, my name is Nick Heesters. I am the Sr. Advisor for Cybersecurity for the HHS Office for Civil Rights. OCR is the federal agency responsible for administering and enforcing the HIPAA Rules. This is the set of Rules that applies to protected health information and sets forth the privacy and security requirements that HIPAA covered entities and business associates, collectively regulated entities, must follow, as well as the rights that individuals have, such as the right to access their health information. We do this through rulemaking and guidance, investigations and enforcement actions, and outdocHub. Today, I would like to discuss the 2021 HITECH Act amendment that adds a requirement for OCR to consider regulated entities implementation of recognized security practices, or RSPs, in certain OCR HIPAA compliance and enforcement activities.
