Property owned jointly with rights of survivorship is treated very much like property owned with multiple beneficiaries. The difference is often in the distribution to remaining owners if one has died. Unless percentage ownership of specific shares is spelled out, only the surviving owners will inherit the property.
With a survivorship deed, when one co-owner passes away, the property title transfers to the surviving co-owners without the need for probate, which can be a time-consuming and somewhat complicated process.
Jointly owned Property with rights of survivorship (JTWROS) offers no protection from creditors. Creditors of any owner can file against any owner of the property. Ways Tenancy by the Entireties can be defeated. Anytime property is changed from TBE to Joint tenants it looses this protection.
This is done through recording an affidavit and a certified death certificate with the county recorders office. The affidavit must recite the names of the other survivorship tenant or tenants, the address of the other survivorship tenant or tenants, the date of death of the decedent.
In Ohio, a survivorship deed creates a joint tenancy between two or more owners. It ensures that the interest rights of a property will be passed to the surviving owner(s) in the event of the other tenants death automatically.
Marriage is the key difference between joint tenants and tenants by the entirety. Without marriage, you cannot own something as tenants by the entireties. More importantly, property that is held as joint tenants or joint tenants with the right of survivorship is not protected from creditors of one of the spouses.
