To start with, the Health Insurance Portability and Accountability Act (HIPPA) that governs privacy when it comes to human medical care does not apply to veterinary patients.
What is veterinary malpractice? Veterinary malpractice is essentially the same as medical malpractice, except the victims are animals. If a veterinarian harms or kills an animal due to carelessness or negligence, this may constitute malpractice.
Whilst medical consent protects a patients rights to make autonomous decisions concerning their own body, veterinary informed consent aims to protect an owners right to make autonomous decisions concerning their legal property.
Consent works like a contract between yourself, as the pet owner, and the surgery. A signed consent form is the most common way to document informed consent. This is a document you will sign to show you have discussed the relevant factors and are happy for the vet to proceed.
Informed consent For non-urgent procedures, the consent discussion should take place in advance of the day of the treatment/procedure where possible. The clients consent to treatment should be obtained unless delay would adversely affect the animals welfare.
Important information. What is informed consent? Whenever your vet wants to undertake a medical or surgical procedure on your pet, they will need your consent.
A veterinarian shall uphold the standards of professionalism, be honest in all professional interactions, and report veterinarians who are deficient in character or competence to the appropriate entities. Complaints about behavior that may violate the Principles should be addressed in an appropriate and timely manner.
The risks and benefits of the procedure for the individual animal should be explained. Consent forms should require the signatures of both parties, with a copy given to the client. Clients should be provided with a copy of the information discussed in advance of the day of surgery.
