In general, it is illegal for your landlord or roommate to change the locks, shut off utilities, or physically remove your belongings without a court order for eviction.
As a general rule, the answer is no: Unless you have a court order excluding your spouse from the home, although you can change the locks on the marital home, you cannot prevent your ex- from returning to the home, even if that means breaking into the home, or even changing the locks again to lock you out.
You just need to do these things: Send a notice of eviction. File a complaint with the Clerk of Court. Attend the eviction hearing. File the writ of possession with the local Sheriff.
Tell them what bothers you. If that doesnt work, figure out how to firmly but politely invite them to move out. If necessary, you may have to take legal action to kick out a roommate who doesnt move out or violates a major agreement. If that isnt an option, you may have to move out yourself.
Regardless of whos on the lease, if your roommate is acting in a way that makes you feel unsafe, you should call the police. The law considers being violent or stalking another tenant just cause for eviction, allowing you to evict the perpetrator with only three days of notice.
​If your roommate is on the lease, the answer is no. Your roommate has as much right to occupy the space as you do. If you want to keep the nonpaying roommate (or anyone else) out by changing the locks, you must get your landlords permission, and youll have to pay the cost.
