For over 20 years, the Blue Guide has been one of the main reference documents explaining how to implement and apply the EU product rules across different sectors and throughout the single market.
There are three common elements to all product liability lawsuits, regardless of the legal theory that the lawsuit is brought under. The lawsuit must involve a product, the product must be found to be defective, and the product defect must be found to be the proximate cause of the injury.
A product is defective when it does not provide the safety a person is entitled to expect. It is not defective if only a improved product is subsequently available. It is the person suffering the damage who has to prove the damage, the defect of the product and the causality between both.
Directive 85/374/EEC: Product liability directive: establishes the principle of producer liability without fault applicable to European producers, such that where a defective product causes damage to a consumer, the producer may be liable even without negligence or fault on their part.
the product liability Directive means the Directive of the Council of the [F5European Union], dated 25th July 1985, (No. 85/374/EEC) on the approximation of the laws, regulations and administrative provisions of the member States concerning liability for defective products.
The European Commission published a proposal for a directive on liability for defective products on Sept. 28, 2022. The amendments are so extensive that the previous Product Liability Directive 85/374/EEC from 1985 shall be completely replaced.
The Blue Guide was first published in 2000. It provides non-binding guidance intended for better understanding of the EUs non-food product safety requirements, the European conformity assessment system, the accreditation of laboratories, CE marking, and EU market surveillance.
