(light music) - Theres a lot of potential consequences and harm that could come from not properly protecting a trademark, but theres really three main things that I counsel clients about that they are concerned about, should be concerned about. The first is when you dont register a trademark, you dont appear in the USPTOs database, and that means youre not taking advantage of the automatic protections and insurance that the USPTO is offering by appearing in their database because when youre in their database, the trademark office will automatically block applications that come after yours that are confusingly similar. And when youre in their database, many people are searching the database when theyre coming up with new brand names or thinking about applying for new brand names, so it may avoid situations from ever arising that the brand owner may never even find out about because they got squashed in their infancy. Two types of strong trade marks are fanciful and arbitrary trade marks. A fanciful trade mark is one that has been devised for the sole purpose of a trade mark, while an arbitrary trade mark is one that uses a word unrelated to the goods or services it is trade marked for.
Strong marks are afforded the greatest protection. As a general rule, arbitrary and fanciful or suggestive marks are considered strong. Descriptive, geographic and personal name marks are considered weak. Generic marks are afforded no protection.
2.1 Article 8(1)(a) EUTMR double identity if it is identical with the earlier trade mark and the goods or services for which registration is applied for are identical with the goods or services for which the earlier trade mark is protected.
The Four Types of Trademarks Generic. Descriptive. Suggestive. Arbitrary or Fanciful.
The strength of a trademark is related to a factor called distinctiveness. A trademark is not very distinctive, and is therefore a weak one, if it is descriptive of the goods or services, a surname, initials or constitutes words commonly used in conjunction with the goods or services.
Descriptive marks are considered weak until they have acquired distinctiveness. Examples include Creamy for yogurt or Worlds Best Bread.
The strongest types of trademarks are (1) fanciful or coined marks, such as EXXON for petroleum products; and (2) arbitrary marks, such as AMAZON for retail services.
Weak trademarks are hard to protect against competitors and often are not federally registrable. These include descriptive and generic trademarks. Descriptive trademarks merely describe some aspect of your goods or services without identifying or distinguishing the source of those goods or services.
