To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
Public Law 14-2022, which went into effect July 1st, amends IC 35-38-9-1 to provide for automatic expungement of all records related to the criminal charges 60 days after dismissal or acquittal. Automatic expungement applies to persons charged with an offense after June 30, 2022.
California began automatically sealing old misdemeanors in 2022, in response to a prior law. In the first six months, state records show the Department of Justice directed county courts to shield 11 million cases from public view, helping six million defendants.
A person must file a petition for expungement, often in the same court in which the criminal prosecution took place. The petition only addresses a single criminal case. If a person wants to expunge records of multiple cases, he or she must file more than one petition.
Your record will automatically be expunged as long as you have never been convicted of a crime in Virginia and you have not been arrested or charged with a crime in Virginia in the last three years. If you do not meet these criteria, you may petition the court for an expungement of your misdemeanor arrest record.
At this time, federal crimes cannot be expunged or sealed. Pennsylvania. Pennsylvania was the first state to enact a clean slate law. Colorado. In Colorado, the automatic sealing of records will commence in July of 2025. Delaware. Oklahoma. Utah. New Jersey. Virginia. California.
Michigan is unique in that its the only state to allow felonies to be automatically expunged.
Currently, 21 states have some type of automatic expungement in place that seals an individuals criminal record from the public. Research shows that expungement leads to more employment opportunities and higher wages for recipients, and that recipients are very unlikely to reoffend, said the paper.
