Qualifying for a Section 18/19 Expungement The defendant was acquitted. The conviction was reversed on appeal and the case subsequently dismissed. A defendant is exonerated by DNA. The Governor grants a full pardon on the basis of a written finding of actual innocence.
Any felony or misdemeanor conviction will remain on your public record forever unless steps are taken to set aside (expunge) the conviction. Some types of convictions cant be removed from an individuals record, including murder, rape, child abuse, or other sexual offenses against minors.
A Section 18 expungement allows a person to expunge their entire arrest record. A Section 991(c) expungement allows a person who received a deferred sentence to expunge their plea, and have the disposition of their case updated to show the case has been dismissed.

Who is Eligible for Expungement? In general, you are eligible to have a record expunged if no charges were filed, the charges were dismissed, the charges were deferred and dismissed, you were found not guilty, or you were pardoned.
Unlike other states, New York does not allow you to expunge your criminal records, which would mean the record is completely destroyed and the crime and conviction is completely erased from your record.
