If you file a Motion to Set Aside a conviction, there are associated costs, such as the cost to obtain fingerprints, $50.00 for the Michigan State Police to analyze your fingerprints, court filing fees, and the cost to obtain a certified copy of your conviction. In all, the costs should not exceed $250.00.
Automatic Expungement Eligible misdemeanors are automatically expunged after seven (7) years. Anyone with more than four (4) eligible misdemeanors cannot get automatic expungement. The federal government does not recognize expungement under Michigans automatic expungement law.
Who Is Eligible for Expungement? Under Michigans new clean slate laws, people who have been convicted of up to two felonies and four misdemeanors will automatically have their criminal record expunged.
On April 11, 2023, Clean Slate Automatic Expungement arrived in Michigan. This new law clears away old criminal records from people who have remained crime-free for a period of years, opening doors of opportunity in jobs, housing and education.
In Michigan, you can apply for an expungement only after five years have passed since your conviction, so filing too soon will result in an automatic denial.
Are There Exclusions to These Automatic Expungements? Assaultive crimes. Serious Misdemeanors. Felony embezzlement. Any crime punishable with a sentence of 10 years or longer. Human trafficking charges. Any violations that involves the injury, serious impairment, or death of a minor or vulnerable adult.
Both misdemeanor and felony convictions are eligible for expungement, depending on the nature of the offense. Certain offenses, such as sex crimes, criminal traffic infractions, or cases where the individual has multiple serious criminal convictions are not eligible.
Who Qualifies For Expungement? Anyone can have a first offense OWI conviction expunged. With the new law, an application for expungement would have to be filed five years after the completion of your probationary period. Anyone that has two or more OWI convictions would not be eligible for this expungement process.
