The current expungement process in Virginia requires the individual charged with the offense to file a petition and fingerprints with the circuit court, pay a filing fee, and possibly attend a hearing on the matter.
Clean Slate Virginia uses new Virginia sealing laws and existing expungement laws to clear criminal records throughout the entire state of Virginia. When criminal convictions are sealed, they cannot be seen by the public or employers.
The Difference Between Sealing and Expunging Criminal Records. In Indiana, expunged records are not destroyed or erased, as seen in other parts of the United States. Following IC 35389, if a court grants the request to expunge a criminal case file, the criminal record is sealed.
Public Law 14-2022, which went into effect July 1st, amends IC 35-38-9-1 to provide for automatic expungement of all records related to the criminal charges 60 days after dismissal or acquittal.
In Indiana, the average cost of expunging a criminal record ranges anywhere from $250 to $1,000 or more. This fee covers the cost of filing petition papers, obtaining court orders and other necessary paperwork fees.

In 2021, the Virginia General Assembly passed a new law that will greatly expand eligibility for record sealing. Non-convictions, many misdemeanor convictions, and some felony convictions will be eligible for sealing, and some of these records will be automatically sealed instead of the typical court process.
For misdemeanors and lower level felonies, you must satisfy these requirements: At least five years since the conviction. No convictions in the five years before applying for an expungement. No currently pending criminal charges.
