Expunging Your Record ($375.00) Preparing petitions, orders, notices, and any corroborating documents. Making court appearances and arguing your case before the judge and filing motions to reconsider, if necessary. The attorneys fee for expunging your record is $375.00.
The total fee for a felony expungement is $300. A $50 non-refundable filing fee is due at the time the application is filed. If the application is granted, the defendant must pay an expungement fee of $250, which can be made in installment payments. The expungement cannot be completed until the full $250 has been paid.
The applicant must complete a Petition for Dismissal form for each case separately and submit it to the Superior Court where the conviction occurred for review and decision by the court. Any supporting documents to show why the court should grant the dismissal/expungement must be filed with the Petition.
The filing fee is $30 for eligible guilty dispositions and is nonrefundable, even if denied. The fee is for each case (not for each charge related within a unit of the case). If you cannot afford the fee, you may request that the court waive the filing fee.
To expunge is to erase or remove completely. In law, expungement is the process by which a record of criminal conviction is destroyed or sealed from state or federal record.
An expungement removes arrests and/or convictions from a persons criminal record entirely as if they never happened. Even a court or prosecutor cannot view a persons expunged record. In contrast, sealing removes a persons criminal record from public view, but it can still be accessed through a court order. Do I have to pay to seal my criminal record? If you apply through the Minnesota Attorney Generals Office and you qualify for expungement you do not have to pay the $300 filing fee to the Court.
