While an expungement is great, there are certain limitations on it. For example, district attorneys and police academies can see these expunged records. Once a charge is expunged, it comes out of those public terminals fairly quickly. But it can take months up to at least six, eight, even a year before those charges are completely removed from the public and private domains. Even after the expungement has been filed, it may take months for private agencies to update their own records to reflect this expungement. Yes, U.S. customs can review expunged records as part of the immigration process. Its important to be aware that expunged records may still be considered.
Expunged records can, in some cases, appear on FBI background checks, especially those conducted by law enforcement or certain government entities.. While expungement is meant to remove or restrict access to criminal records, the effectiveness of the process varies by jurisdiction.
Specifically, the FAA will expunge no-finding civil penalty actions five years after the date an individual subject to the civil penalty action or his or her representative: (1) pays the civil penalty; or (2) provides a promissory note for payment of the civil penalty to the FAA.
The past ten years of employment must be reviewed while the most recent five years must be verified in writing, including documentation of date and method of how contact was made. A contact person must also be listed on the record indicating from whom verification information was obtained.
Thus, agencies such as the Transportation Security Administration (TSA), Federal Aviation Administration (FAA), Department of Homeland Security (DHS), and Federal Bureau of Investigation (FBI), for example, will most likely still be able to see your expunged records.
Most states dont have such an expunction of convictions. At most you get sealing, which is an agreement not to disclose the conviction to most inquiries, but the FAA can see them.
